Before you start using our products and services, please be sure to read and understand this policy carefully, especially the terms marked in bold/bold underline. Your agreement to the Privacy Policy indicates that you have understood the functions and content of data4 products and services, as well as the necessary personal data required for the operation of data4 products and various functional modules and value-added services, and have given the corresponding collection and use authorization. Unless you read and accept all the terms of this Agreement, please do not download, install or use data4 products and related services. Your actions such as clicking to agree, downloading, installing, using, logging in, etc. shall be deemed that you have read and agreed to be bound by this Agreement. This Privacy Policy is an integral part of the data4 Service Agreement (whether electronic or non-electronic) signed between you and us.
I. Scope
This policy applies to all products and services provided to you by data4 service providers in the form of websites, software clients, and new forms that emerge with technological development. Except for the relevant data collection and use activities described in this policy, this policy does not apply to other services provided to you by data4 partners and other third parties. Other services are subject to the personal data collection and use rules separately explained to you.
II. Data Collection and Use
When you use our products/services, we need/may need to collect and use your personal data, including the following two types:
1. In order to realize the basic functions of providing you with our products and/or services, you must authorize us to collect and use the necessary data. If you refuse to provide the corresponding data, you will not be able to use our products and/or services normally;
2. In order to realize the additional functions of providing you with our products and/or services, you can choose to agree or disagree with the data we collect and use separately. If you refuse to provide it, you will not be able to use the relevant additional functions normally or achieve the functional effects we intend to achieve, which will not affect your use of our basic functions.
We would like to remind you in particular: We are committed to creating a variety of products and services to meet your needs. Because we provide you with a wide range of product function modules and services, and different users choose to use different specific products/services, the basic/additional functions and the corresponding types and scopes of personal data collected and used will be different. Please refer to the specific product function modules and service functions.
The specific functional scenarios we will provide you include but are not limited to:
1. Free version, paid version and exclusive customized version of data4 product functional module services
We provide you with services based on the packages or functional modules you create and order from data4 for your data4 account. In order to create an data4 account, you need to provide us with at least your mobile phone number or email address. If you refuse to provide the above data, you will not be able to register an data4 account.
To ensure the security of the platform and prevent automated program attacks, we use CAPTCHA during user login and registration. In this process, we may collect the following information: including but not limited to user input data, device and browser information, and behavioral data. This data is solely used to verify the authenticity of users, prevent malicious attacks, and protect the security of the platform. We will not use this data for other purposes nor share it with third parties, except as required by law or to prevent fraud and piracy.
When you use data4 products and services, or visit the data4 browser platform webpage, the data4 browser will automatically receive and record data on your browser and computer, including but not limited to your IP address, browser type, language used, access date and time, software and hardware feature data, web pages you visit, your service logs and operation logs.
In order to ensure that we are providing services for you personally, we may verify your identity based on the above data you provide. If there is a scenario where your necessary identity needs to be determined according to law (including protecting the rights and interests of minors, combating telecommunications network fraud, withholding taxes for you, administrative law enforcement or identification of relevant subjects in judicial proceedings), you can authorize the facial recognition verification channel we provide for verification, and the verification data is used for the above purposes.
2.Additional Services
You can choose to further improve the account data of this product, and you can provide us with your nickname, mobile phone number, etc. to obtain additional services that better meet your needs. You can also choose not to provide them, but you will not be able to obtain related services, but it will not affect the normal use of other functions and services.
data4 will initiate operational activities for newly launched services and functions from time to time. If you participate in relevant operational activities, we will collect data including but not limited to your identity data and contact data through the operational activity interface in order to contact you, verify your eligibility for rewards, and issue operational rewards to you. If you do not participate in relevant operational activities, you do not need to provide the above data. If you participate in operational activities but refuse to provide them, you will not be able to obtain relevant rewards.
3. Help you complete payment
To complete order payment, you may need to provide an Alipay account, WeChat account or choose other payment methods to pay. For example, if you choose Alipay to pay, we will share your data4 account, the corresponding Alipay account member name, order payment related data, order security related equipment data and other necessary data required by anti-money laundering laws with Alipay through the Alipay tool development kit (SDK) embedded in the application.
If you choose WeChat to pay, we will share your data4 account, the corresponding WeChat account member name, order payment related data, order security related equipment data and other necessary data required by anti-money laundering laws with WeChat through the WeChat tool development kit (SDK) embedded in the application.
If you choose other financial institutions to provide you with payment services, we will also share your bank card payment necessary data including bank card number and expiration date with the corresponding financial institution you choose.
In order to enable us to promptly learn and confirm your payment progress and status and provide you with after-sales and dispute resolution services, you agree that we may collect transaction data related to payment progress from the transaction partner you choose, Alipay Company or other financial institutions you choose. This data is collected and used to facilitate the transaction you requested. Some transaction data is personal data and may include: your name, email address, contact number, payment method information (such as credit card or debit card number, bank account details or photos of the payment card you choose), the amount and date of purchase of data4 products, and the transaction order number.
4.Customer Service and Dispute Resolution
When you contact us or apply for pre-sales, after-sales, or dispute resolution, in order to protect the security of your account and system, we need you to provide necessary personal data to verify your membership.
In order to facilitate contacting you, helping you solve problems as soon as possible, or recording solutions and results of related problems, we may save your communication, correspondence/call records and related content with us (including account data, address, email, other data you provide to prove relevant facts, or contact data you leave). If you inquire, complain or provide suggestions for a specific order, we will use your account data and order data.
In order to provide services and improve the reasonable needs of service quality, we may also use your other data, including the relevant data you provide when you contact customer service and the questionnaire response data you send to us when you participate in the questionnaire survey.
We provide you with quick payment and automatic renewal services, that is, you can choose to save your payment information for the next payment, or you can choose to enable the automatic renewal function. The payment information you choose to save can be used to enable the automatic renewal service and to pay for each subsequent automatic renewal order. You can refer to the relevant rules through the quick payment and automatic renewal pages and the data4 Automatic Renewal Agreement.
III. Providing Data to External Parties
1. Sharing
We will not share your personal data with companies, organizations, and individuals other than data4 service providers, except in the following circumstances:
(1)Sharing necessary for fulfilling legal obligations: We may share your personal data in accordance with laws and regulations, litigation, dispute resolution, or in accordance with the requirements of administrative and judicial authorities in accordance with the law, as well as other legal obligations.
(2)Sharing with your consent: We will share your personal data with other parties after obtaining your explicit consent.
(3)Sharing necessary for the conclusion and performance of a contract to which you are a party: When you purchase goods or services through data4, we will share the necessary transaction-related data in your order data with the provider of the relevant goods or services according to your choice to meet your transaction, delivery, and after-sales service needs.
(4)Sharing with affiliated companies: In order to facilitate us and affiliated companies to jointly provide you with some services, provide you with products and services based on the data4 platform account, recommend data that may interest you, identify member account anomalies, and protect the personal and property safety of data4 affiliated companies or other users or the public from infringement, your personal data may be shared with our affiliated companies and/or their designated service providers. We will only share necessary personal data and will be subject to the purposes stated in this policy. If we share your sensitive personal data or our affiliates change the purpose of using and processing personal data, we will ask for your authorization again.
Please note that the data you voluntarily share or even publicly share when using our services may involve your or others' personal data or even sensitive personal data. Please consider and make decisions more carefully.
2.Entrusted processing
We may entrust authorized partners to process your personal data so that the authorized partners can provide you with certain services or perform functions on our behalf. 1. We attach great importance to the security of your data and will strive to take reasonable security measures (including technical and management aspects) to protect your personal data. We have set up security protection functions for user accounts, and through security measures such as encrypting user passwords, we prevent the personal data you provide from being improperly used or accessed, disclosed, used, modified, damaged, lost or leaked without authorization.
2. The data we collect is stored in a secure operating environment that is not open to the public. In principle, we do not charge any fees for your reasonable requests, but for repeated requests that exceed reasonable limits, we will charge a certain cost fee depending on the circumstances. We may reject requests that are unreasonably repeated, require too many technical means (for example, the development of new systems or fundamental changes to current practices), pose risks to the legitimate rights and interests of others, or are extremely impractical (for example, involving information stored on backup tapes).
VI. Storage of data
We will only retain your personal data for the period required to achieve the purposes described in this policy, unless there are mandatory retention requirements by law, such as the "E-Commerce Law of the People's Republic of China" requires that product and service data and transaction data be kept for no less than three years from the date of completion of the transaction.
We judge the storage period of personal data mainly based on the following standards:
